Payment Under Protest Letter Templates

The payment under protest procedure is a method of establishing the claim between disputants and claiming the right from the other party for delay damages. This process begins with sending a letter to the creditor called a pre-protest notification. Once this notice is sent, there is 30 days after which if the creditor does not respond then the debtor may file a payment under protest.

If the creditor does respond within 30 days, there are numerous reasons that can be used to deny the claims made in the notice of impending litigation. The debtors must appeal their case by providing all evidence of why they believe they should not have to pay the debt or claim.

The final step in the process is to file a complaint with the court, stating why you believe that you do not owe any money and why the creditor has no case against you. Once the case has been filed, it will be scheduled for trial where both parties put their claims on display before a judge. After the trial, the judge will make a decision based on evidence presented by both parties.
